Article 1 (Purpose)
The purpose of these Terms of Service is to stipulate the rights, obligations, and other necessary matters between Everspin Co., Ltd. (hereinafter referred to as the 'Company') and the 'User' regarding the use of internet services provided on the EVERSPIN site (https://everspin.global) operated by the 'Company'.
Article 2 (Definitions)
- ‘Company’ refers to Everspin Co., Ltd.
- ‘EVERSPIN Site’ refers to the website (https://everspin.global) operated by the ‘Company’ for the provision and use of services.
- ‘User’ refers to a person who accesses the ‘EVERSPIN Site’ and uses the services provided by the ‘Company’ in accordance with these Terms of Service.
Article 3 (Specification, Explanation, and Amendment of Terms)
- The ‘Company’ shall post the contents of these Terms of Service on the ‘EVERSPIN Site’ so that the User can recognize them.
- The ‘Company’ may amend these Terms of Service to the extent that it does not violate relevant laws, such as the Act on the Regulation of Terms and Conditions and the Act on Promotion of Information and Communications Network Utilization and Information Protection.
- In the event that the ‘Company’ amends the Terms of Service, it shall specify the effective date and the reason for the amendment and announce them on the ‘EVERSPIN Site’ from 7 days prior to the effective date until the day before the effective date.
- If the ‘User’ does not expressly indicate their refusal to the amendment by the effective date of the amended Terms of Service, or if they use the service after the amendment, they shall be deemed to have agreed to the amended Terms of Service.
Article 4 (Provision and Restriction of Services)
- The ‘Company’ provides the following services to the ‘User’ through the ‘EVERSPIN Site’:
- Provision of information about the Company
- Provision of inquiry and consultation application functions
- Provision of newsletters and other information (limited to applicants)
- Other tasks determined by the ‘Company’
- The ‘User’ must comply with relevant laws and regulations while using the service and must not engage in any of the following acts:
- Registration of false information upon application or change
- Theft of other people's information
- Infringement of intellectual property rights, such as copyrights of the ‘Company’ and other third parties
- Acts that damage the reputation of the ‘Company’ or other third parties or interfere with their business
- The ‘Company’ may temporarily suspend the provision of services for a period necessary for the smooth performance of services, and may restrict or discontinue the provision of services in the event of force majeure.
Article 5 (Privacy Protection)
The ‘Company’ does its best to protect the personal information of the ‘User’. How the ‘Company’ protects and handles personal information when the ‘User’ uses the service can be found in the ‘Company's’ Privacy Policy.
Article 6 (Dispute Resolution)
- Only these Terms of Service apply to the legal relationship between the ‘Company’ and the ‘User’. No representation or agreement made or entered into elsewhere, whether directly or indirectly, shall be binding on the ‘Company’ unless the ‘Company’ expressly confirms it to the ‘User’ in writing.
- The relationship between the ‘User’ and the ‘Company’ according to these Terms of Service shall be governed by the laws of the Republic of Korea, notwithstanding conflict of laws rules. In the event of a lawsuit regarding a dispute arising from the use of the service, it shall be resolved by mutual consultation; however, if an agreement is not reached and a dispute arises, the court having jurisdiction over the location of the ‘Company's’ headquarters shall be the competent court.
Article 7 (Obligations regarding Member's ID and Password)
- The ‘Member’ is responsible for the management of their ID and password.
- The ‘Member’ must not allow a third party to use their ID and password.
- If the ‘Member’ recognizes that their ID and password have been stolen or are being used by a third party, they must notify the ‘Company’ immediately and follow the ‘Company's’ instructions if any.
Article 8 (Privacy Protection)
The ‘Company’ does its best to protect the personal information of the ‘User’. How the ‘Company’ protects and handles personal information when the ‘User’ uses the service can be found in the ‘Company's’ Privacy Policy.
Supplementary Provisions
These Terms of Service shall be effective from January 30, 2026.
The previous Terms of Service are replaced by these Terms of Service.
